1. General Provisions \u2013 Scope of Application<\/strong>
The following General Terms and Conditions apply to all contracts for deliveries and other services between<\/p>\n

hereinafter referred to as \u201cEliteGold\u201d<\/strong> and the customer<\/strong>, hereinafter referred to as \u201cCustomer<\/strong>,\u201d in the version in effect at the time the contract is concluded. They form an integral part of the business relationship. <\/p>\n

Any terms and conditions of the customer that conflict with or deviate from our General Terms and Conditions shall be invalid unless EliteGold<\/strong> agrees to their validity in writing.<\/p>\n

For all future transactions with a customer who is a business entity, a legal entity under public law, or a special fund under public law, EliteGold\u2019s<\/strong> General Terms and Conditions shall apply even if their applicability is not expressly stated again.<\/p>\n

The customer must have full legal capacity and be of legal age for a contract to be validly concluded.<\/p>\n

The language of the contract is German.<\/p>\n

2. Buyback Calculator<\/strong>
On the EliteGold<\/strong> website https:\/\/elitegold.de<\/a>, customers can calculate the estimated buyback price of precious metals and valuables containing precious metals under \u201cBuyback Calculator\u201d in the menu without having to register. To do so, customers must enter the weight of the respective item in the field provided for the relevant alloy. <\/p>\n

Based on the weight information provided by the customer and using the current daily buying rates, the system then displays the estimated purchase price that the customer would likely receive for the specified alloy and quantity at the time of calculation, subject to the accuracy of the customer\u2019s information and EliteGold\u2019s<\/strong> appraisal.<\/p>\n

The calculation of these values is a free service provided by EliteGold<\/strong> for an initial, non-binding valuation. The values listed (payout amounts) do not constitute binding offers from EliteGold<\/strong>. <\/p>\n

3. Submission \u2013 Risk Assumption<\/strong><\/p>\n

On the website https:\/\/elitegold.de , customers can <\/a>use an online form to request a shipping envelope and a cover letter, which allows them to send their valuables containing precious metals to EliteGold<\/strong> at the company\u2019s expense.<\/p>\n

To do this, the customer must enter their name, address, and email address in the form on the website and click \u201cOrder Shipping Envelope.\u201d<\/p>\n

When sending valuables to EliteGold<\/strong> using the prepaid shipping envelope provided, shipping via Deutsche Post is at EliteGold\u2019s<\/strong> expense and risk.<\/p>\n

Deutsche Post is the customer\u2019s sole contractual partner for shipping and insurance. When shipping via DHL, valuables are insured for up to \u20ac2,500.00. If the value exceeds this amount, a pickup can be scheduled. <\/p>\n

The customer agrees to drop off the shipping envelope at a Deutsche Post branch when using this service. The customer will receive a shipping label to take advantage of free shipping. The shipping label and the
tracking number are the only proof that the customer has shipped valuables to EliteGold<\/strong>. <\/p>\n

If the customer does not use the EliteGold shipping envelope, it is still mandatory that the customer include the fully completed and signed shipping form with the shipment. The shipping form is provided by EliteGold at https:\/\/elitegold.de<\/a>. <\/p>\n

Shipments of jewelry, gold, dental gold, silver, platinum, and other precious metals or valuables to EliteGold that do not use the shipping envelope or shipping label provided by EliteGold<\/strong> or are not picked up free of charge by the security courier we have commissioned via
are at the sender\u2019s expense and risk.<\/p>\n

EliteGold reserves <\/strong>the right to refuse delivery of packages that appear to have been damaged, opened, or otherwise tampered with during shipping. Such packages will be returned to the customer at EliteGold\u2019s expense, without any liability on the part of EliteGold. <\/p>\n

By submitting the items, the customer confirms that all items, without exception, are free from any third-party rights, that they are the customer\u2019s unrestricted property over which the customer has full authority to dispose of, and that the items do not originate from any criminal activity.<\/p>\n

4. Appraisal \/ Weight and Value Assessment<\/strong>
Once the valuables arrive at EliteGold<\/strong>, they are assessed for their pure precious metal value.<\/p>\n

By submitting or presenting the valuables, the customer consents to the appraisal of the valuables sent or presented.<\/p>\n

The customer acknowledges that EliteGold<\/strong> exclusively appraises and purchases the precious metals gold, silver, platinum, and palladium, as well as jewelry and other valuables containing one or more of these precious metals.<\/p>\n

EliteGold notes that precious stones, gemstones, and other decorative materials contained in the items are neither inspected nor purchased. EliteGold<\/strong> also does not remove these items from the valuables and return them to the customer. <\/p>\n

EliteGold therefore strongly advises that you remove all inlays that EliteGold<\/strong> does not purchase and that you wish to keep before sending the item to EliteGold<\/strong>, or have them removed by a professional.<\/p>\n

The customer expressly confirms that, in the event that unmounted valuables are sent in and the customer accepts EliteGold\u2019s <\/strong>offer after it has been submitted <\/strong>, the mounting materials shall be deemed to have been sold as part of the transaction
.<\/p>\n

The determination of the precious metal weight of dental gold that contains deposits such as dental and\/or ceramic residues, is performed through a professionally conducted estimation of the total weight minus the non-precious metal foreign substances or materials (so-called \u201cmelting losses\u201d).<\/p>\n

5. Defects<\/strong>
EliteGold<\/strong> will notify the customer of any damage to shipped items immediately upon becoming aware of it, so that the customer can file a damage report with the shipping company.<\/p>\n

EliteGold<\/strong> will also notify the customer of any shortfalls or discrepancies from the packing slip and reserves the right to return the items to the customer at the customer\u2019s expense in the event of significant discrepancies.<\/p>\n

6. Offer \/ Return<\/strong>
Once EliteGold<\/strong> has assessed the items for their pure precious metal value, EliteGold<\/strong> will generally send the customer a non-binding valuation via email within 48 hours, based on current market prices. The valuation is based on the purchase prices at the time the items offered are evaluated. <\/p>\n

If EliteGold is not interested in purchasing the items or if the customer does not agree with the valuation, the valuables will be returned to the customer immediately and at no cost to the customer to the address provided by the customer. EliteGold<\/strong> is under no obligation to purchase the items.<\/strong> <\/p>\n

The customer is responsible for the return shipping costs if they do not respond to an offer from EliteGold<\/strong> within seven business days of receiving the valuation report or if they send items that do not contain precious metals.<\/p>\n

If individual items or parts of the items sent cannot be purchased\u2014for example, because they do not contain precious metals\u2014they will be returned at the customer\u2019s request and expense. Unless the customer expressly requests a return within 14
days of notification, EliteGold<\/strong> will dispose of the items free of charge .<\/strong> <\/p>\n

If the customer agrees with the valuation, they shall notify EliteGold<\/strong> accordingly, thereby submitting a binding offer to enter into a purchase agreement for the valuables they have sent to EliteGold<\/strong> at the value determined by EliteGold.<\/p>\n

7. Conclusion of the Contract<\/strong>
A contract is concluded upon EliteGold\u2019s<\/strong> written declaration of acceptance. Payment of the purchase price is deemed equivalent to a declaration of acceptance. <\/p>\n

The purchase of the items sent or presented is based on the customer\u2019s confirmation that all items, without exception, are free from third-party rights, that they are the customer\u2019s unrestricted property, over which the customer has full power of disposal, and that the items do not originate from a criminal act.<\/p>\n

8. Payment<\/strong>
Once the contract is concluded, the purchase price will be paid exclusively and immediately to the person named in the confirmation of ownership. Payment will be made via PayPal or by online bank transfer directly to the bank account. <\/p>\n

If you bring the items you wish to sell in person, we can also accept cash.<\/p>\n

The purchase of valuables from business owners acting in the course of their commercial or self-employed professional activities must be reported separately to EliteGold<\/strong> in accordance with Section 14 of the German Civil Code (BGB).<\/p>\n

A commercial seller shall promptly submit a valid invoice to EliteGold<\/strong>. Payment will be made immediately upon receipt. <\/p>\n

9. Transfer of<\/strong>Ownership
Ownership of the purchased items is transferred to<\/strong> EliteGold<\/strong> upon payment of the purchase price.<\/p>\n

10. Returns<\/strong>
In the case of a proper return, the risk of accidental loss or accidental deterioration passes to the customer as soon as the items have been handed over to the person or entity designated to carry out the shipment, but no later than when the items leave the premises.<\/p>\n

The customer is required to inspect the returned goods immediately upon receipt to ensure they are complete and undamaged, and to check for any discrepancies in quantity, weight, number of items, or packaging.<\/p>\n

Any complaints must be reported to EliteGold<\/strong> in writing immediately upon receipt of the returned item.<\/p>\n

11. Money Laundering<\/strong>
In accordance with the provisions of the Money Laundering Act (GwG), customer identification is required for all cash transactions exceeding \u20ac10,000.<\/p>\n

To do this, we need a copy of the customer’s valid ID card or passport.<\/p>\n

12. Limitations of Liability and Indemnification<\/strong>
Outside the scope of the Product Liability Act, EliteGold\u2019s <\/strong>liability is limited to <\/strong>cases of willful misconduct or gross negligence. Liability for slight negligence, compensation for consequential damages and financial losses, lost savings, loss of interest, and damages arising from third-party claims against the customer is excluded.
The foregoing limitations of liability do not apply to bodily injury, health damage, or loss of life attributable to EliteGold<\/strong>. The limitation of liability for slight negligence does not apply to consumers. Furthermore, the foregoing limitations of liability do not apply to damage to items handed over to EliteGold for <\/strong>processing. <\/p>\n

13. No right of withdrawal<\/strong>
EliteGold<\/strong> expressly notes that in the case of a distance contract for goods or services whose price depends on fluctuations in the financial market over which the business has no control and which may occur within the cancellation period, there is no right of withdrawal pursuant to Section 312d(4), Sentence 6 of the German Civil Code (BGB). <\/p>\n

14. Place of Performance \/ Governing Law \/ Jurisdiction<\/strong>
. The place of performance is M\u00fcnster.<\/p>\n

German law applies. The provisions of the United Nations Convention on Contracts for the International Sale of Goods do not apply. With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence. <\/p>\n

The exclusive venue for all claims arising from the business relationship between EliteGold<\/strong> and the customer is M\u00fcnster, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law, or that
does not have a general venue in Germany.<\/p>\n

15. Privacy Policy<\/strong>
We process personal data (hereinafter generally referred to as \u201cdata\u201d) only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.<\/p>\n

According to Article 4(1) of the General Data Protection Regulation, \u201cprocessing\u201d means any operation or set of operations performed on personal data, whether or not by automated means, such as collection,
recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment
or combination, restriction, erasure, or destruction.<\/p>\n

In this regard, we expressly refer you to our Privacy Policy for further details, particularly regarding customers\u2019 rights, which you here<\/strong> <\/a>.<\/p>\n

EliteGold<\/strong> does not store the contract text, but it does store the cover letter and the acceptance form.<\/p>\n

16. Severability Clause<\/strong>
If any provision of the contract with the customer, including these Terms and Conditions, is or becomes invalid in whole or in part, this shall not affect the validity and enforceability of the remaining provisions. If the provisions are invalid or have not become part of the contract, the content of the contract shall be governed by the statutory provisions. <\/p>\n
